Terms of Service

These Terms of Service (“Terms”) apply to your use of slimmarty.com, our phone and text lines, and the services provided by Slim Marty (“Slim Marty,” “we,” “us,” or “our”), 7110 W Higgins Ave, Chicago, IL 60656. By using our website or services, you agree to these Terms.

Our Services

We provide search engine optimization (SEO), website design and development, pay-per-click advertising, email and social media marketing, AI phone agents and custom CRM software. The scope, deliverables, price and timeline of any project are set out in a written proposal, quote or agreement. If that agreement conflicts with these Terms, the agreement controls.

SMS Terms

• Program: Slim Marty sends text messages from (217) 335-6111 about your inquiry, scheduled meetings (confirmations and reminders) and project updates. We do not send marketing texts.
• Consent: you opt in by ticking the optional SMS consent box on our contact form, or by saying yes when we ask “May we text you a confirmation at this number?” on a call. We record verbal consent with the date and time. Consent is not a condition of purchase.
• Frequency: message frequency varies with your inquiry or project.
• Cost: message and data rates may apply.
• Opt out: reply STOP, CANCEL, END, QUIT or UNSUBSCRIBE at any time. You will get one message confirming you are unsubscribed. Reply START to resubscribe.
• Help: reply HELP, call (217) 335-6111 or email contact@slimmarty.com.
• Carriers: carriers are not liable for delayed or undelivered messages.
• Privacy: see our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

AI Phone Assistant

Our phone lines may be answered by an AI assistant. It can answer general questions, take your details for a callback and book meetings. Information from the assistant is for general guidance only. Prices, scope and commitments are binding only when confirmed in writing by Slim Marty.

Meetings and Consultations

Consultations may be held at your location, at our office or online. Please let us know at least 24 hours ahead if you need to reschedule or cancel. On-site visits are available within our service area.

Quotes, Payment and Cancellation

• Quotes are valid for 30 days unless stated otherwise.
• Payment terms (deposits, milestones or monthly fees) are set out in your proposal or agreement. Invoices are due by the date shown on them.
• Monthly services (such as SEO, ads management, hosting, AI phone agents and CRM hosting) continue month to month until cancelled in writing, with the notice period stated in your agreement.
• Third-party costs, such as ad spend, domain names, hosting, phone numbers, SMS fees, AI usage and software subscriptions, are your responsibility unless your agreement says otherwise.

Your Responsibilities

• Provide accurate information, content and timely access to the accounts and systems we need.
• Make sure you have the rights to any content, logos and data you give us.
• Where we set up phone agents, texting or CRMs for you, you are responsible for your own customers’ consent, your own privacy policy and compliance with the laws that apply to your business, including texting, call-recording and privacy laws.

Results

Search rankings, ad performance, call volumes and business results depend on factors outside our control, including search engines, ad platforms and competitors. We do not guarantee specific rankings, leads or revenue. Past results for other clients do not guarantee future results.

Intellectual Property

Once paid in full, you own the final deliverables created specifically for you, such as your website content and design, unless your agreement says otherwise. We keep ownership of our pre-existing tools, code libraries, templates, know-how and any software licensed rather than sold to you, and you receive a license to use them for your business. Third-party software and services remain subject to their own terms.

Website Use

You may not misuse our website, attempt to access it without authorization, interfere with its operation, or use it for anything unlawful. Content on this website is for general information and may change without notice.

Limitation of Liability

To the fullest extent allowed by law, Slim Marty is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or business. Our total liability for any claim is limited to the amount you paid us for the service in question during the three months before the claim.

Disclaimer

Our website and any AI assistant information are provided “as is.” Except as stated in a written agreement, we make no warranties, express or implied.

Governing Law

These Terms are governed by the laws of the State of Illinois. Any dispute will be resolved in the state or federal courts in Cook County, Illinois.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they were last changed.
